虐待罪是指共同生活的家庭成员,经常以打骂、冻饿、禁闭、强迫过度劳动、限制人身自由、凌辱人格等方法,从肉体和精神上进行摧残和折磨,情节恶劣的行为。针对当今社会中家庭虐待案件的发生,将虐待的各种手段、特征结合到真实案件中,进行深层剖析,准确把握虐待罪。对虐待罪的法律规范提出改善意见,使法律的公平与正义的精神得以切实体现。
Abuse is defined as the cohabitation and torture of physically and mentally abusive behavior of family members living together. They often abuse and cry, imprisonment, overcrowding, restrictions on personal freedom and abuse of personality. Aimed at the occurrence of domestic abuse cases in today’s society, the various means and characteristics of abuse are integrated into real cases to conduct in-depth analysis and accurately grasp the crime of abuse. Put forward suggestions on improving the legal norms of maltreatment so that the spirit of fairness and justice in the law can be effectively reflected.
