正当法律程序的内涵在于它要求一切过程都要符合法律规定的程序,本质在于防止专横和滥用国家权力,保护公民的权利不受非法侵害。它要求刑事简易程序的设计能够符合程序理念,能够保障程序正义,并且保障被告人在刑事诉讼中最基本的权利。我国现行刑事简易程序对被告人的基本权利重视不够,应当采取更加完善的措施保障被告人的基本权利。
The essence of due process of law lies in the fact that it requires that all processes comply with the procedures prescribed by law. The essence is to prevent arbitrary and abuse of state power and protection of citizens’ rights from unlawful infringement. It requires that the design of the criminal summary procedure be in conformity with the procedural idea, be able to protect the procedural justice, and safeguard the most basic rights of the accused in criminal proceedings. The current criminal summary procedure in our country has paid insufficient attention to the basic rights of defendants and should take more complete measures to protect the basic rights of defendants.
