这篇文章主要叙述了在施罗德总理10多年前提出的“2010年议程”的实施过程中,劳务派遣制度在德国持续的自由化发展。很显然,企业在很大程度上是将劳务派遣作为一种工具使用,从而达到以廉价劳动力代替本土雇员的目的。随着大量滥用案例的被揭露,临时用工制度在过去几年中再一次受到了严格的限制。目前需要关注的是,许多企业尝试通过与自由职业者签订承揽合同和劳务合同来代替劳务派遣。此处所谓的虚假承揽合同区别于真实的与自由职业者签订的合同,它实际上应被认定为劳动合同或劳务派遣合同。
This article mainly describes the continuous liberalization of the labor dispatch system in Germany during the implementation of the 2010 Agenda 10 put forward by Premier Schoder more than 10 years ago. Obviously, enterprises are largely using labor dispatch as a tool to achieve the goal of replacing local employees with cheap labor. With the mass abuse cases uncovered, the temporary employment system has been once again severely restricted in the past few years. What needs to be watched now is that many businesses try to replace labor dispatch by contracting contracts and labor contracts with freelancers. The so-called false contract here is different from a real contract with a freelancer, which should actually be recognized as a labor contract or labor dispatch contract.
