在公民与国家的关系问题上存在的理论争论伴随着西方宪政哲学发展的始终。本文简要回顾了这段理论争论的变迁过程,试图归纳出五段重要的发展阶段,即古代的理论萌芽,中世纪神学观支配的理论虚构,近代的法学理论重塑,现代社会学理论主导的理论发展,以及当代对该问题讨论的多元与深入。
The theoretical controversy over the relationship between citizens and the state is accompanied by the development of the constitutional philosophy in the West. This article briefly reviews the changing process of this theoretical controversy and attempts to conclude five important stages of development: the sprouting of ancient theories, the theoretical fictionalization dominated by theological concepts of the Middle Ages, the remodeling of modern legal theories and the theory led by modern sociological theories Development and contemporary discussion on the issue of diversity and depth.
