网络环境和技术自身的特征赋予了网络环境下的商标侵权不同于传统领域的商标侵权的新特征,即多样性、隐蔽性和跨地域性。网络技术的不断发展也使得商标侵权的类型从通过网络技术进行传统的商标侵权活动,即网络销售商标侵权行为,发展为网络环境下专有的商标侵权行为,即网络域名商标侵权行为、网络链接商标侵权行为以及网络搜索引擎商标侵权行为。应尽快对这一问题进行相应的立法,从而不断我国的知识产权法律制度和促进社会经济的发展。
