《欧盟统一销售法案》是保护欧盟消费者的一部重要法律,消费者保护强制性规则是该法的一项重要规则。该规则可以细化为消费者权益强制性保护规则,信息披露强制性规则,合同订立与撤销强制性规则,合同违约与合同解释强制性规则。随着欧盟经济一体化的深入以及消费市场的发展,发现强制性规范规则存在诸多问题。通过分析欧盟消费者保护强制性规则的不足及成功之处,完善我国消费者保护法中的强制性规范规则,以此更好的保护消费者权益以及规范市场行为。
The Uniform Sales Act of the EU is an important piece of legislation protecting consumers in the EU. Consumer protection mandatory rules are an important rule of the law. The rules can be refined into compulsory consumer protection rules, mandatory disclosure rules, contract formation and withdrawal mandatory rules, contract breach and contract interpretation mandatory rules. With the deepening of EU economic integration and the development of the consumer market, many problems have been found in the mandatory normative rules. By analyzing the inadequacies and successes of the EU consumer protection mandatory rules, we improve the mandatory norms and rules in the Consumer Protection Law in order to better protect the rights and interests of consumers and standardize the market behavior.
