现有的食品安全法律概念呈现泛化的趋势,以“食品安全”涵盖“食品质量”不利于构建科学、高效的国内和国际食品安全法律规制体系。为扭转这一泛化趋势,我们需平衡食品安全中的科学和价值观因素,以风险为切入点,以科学为基础界定食品安全。同时,我们需谨慎对待与食品安全法律概念泛化密切相关的两个争议性问题:生产过程与生产方法(PPM)和动物福利,主张只有对最终食品的安全性能够产生可识别性影响的PPM和动物福利贸易措施才应纳入食品安全国际法律规制的范围。
The existing legal concept of food safety presents a trend of generalization. It is not conducive to the construction of a scientific and efficient legal regulation system for food safety in China and in the world with “food safety” covering “food quality”. To reverse this generalization trend, we need to balance science and values in food safety with risk as a starting point and science-based food safety. At the same time, we need to be cautious about two controversial issues that are closely linked to the generalization of the legal concept of food safety: production processes and production methods (PPM) and animal welfare, arguing that PPMs that have a recognizable impact on the safety of the final food And animal welfare trade measures should be included in the scope of international legal regulation of food safety.
