本文通过对我国教育行政审批改革历程的梳理,找出其在不同改革阶段的特征,检视其存在的问题。以往的教育行政审批改革的不足集中表现为法治化程度不高,具体表现为改革难免带有形式化、运动式的印记,改革过程缺乏公众参与,非行政许可审批呈潜在增长趋势等,进而提出以下对策和建议:通过制定权力清单,公布负面清单;完善外部监督机制;完善动态的决策机制,促进改革的科学化、民主化;取消非行政许可审批,推进改革的法治化。
Through the combing of the reform process of education administrative examination and approval in our country, this paper finds out its characteristics in different reform stages and examines its existing problems. In the past, the inadequacies in the reform of educational administration examination and approval focused on the low level of the rule of law. The concrete manifestation was that the reform inevitably had a formalized and sporting imprint, the public participation in the reform process was not enough, and the non-administrative licensing approval showed a potential growth trend. The following countermeasures and suggestions are proposed: a list of powers should be formulated to publish a negative list; the mechanism for external oversight should be perfected; a dynamic decision-making mechanism should be perfected to promote scientific and democratization of the reform; the approval of non-administrative licenses should be canceled and the legalization of the reform should be promoted.
