目前,对于农业遗传资源我国无论在学理中还是在实践中均没有明确的定义,不同的研究领对这一概念有不同的理解。由于概念的明确是立法的前提,本文力图从法律概念的界定这一角度入手,对农业遗传资源进行法律上的定义,以期明确我国农业遗传资源的立法目的,加快我国农业遗传资源的立法保护进程。
At present, there is no clear definition of agricultural genetic resources in our country whether in academic study or in practice. Different research leaders have different understandings of this concept. As the concept of the clear is the premise of legislation, this article tries to start from the definition of legal concept of legal definition of agricultural genetic resources, with a view to clarify the legislative purpose of China’s agricultural genetic resources and accelerate the legislative protection of China’s agricultural genetic resources .
