2008年汶川地震后公益报道如雨后春笋般兴盛于我国新闻报道中。公益报道不仅仅体现着我国公益事业的繁荣,也是媒体承担社会责任的一种方式。但是在我国公益报道中,未成年人的隐私权和姓名权的保护却时时受着威胁。由于公益报道的特殊性,第三人利益、公众知情权与未成年人权益的保护之间的博弈也时时存在。本文拟从汉德公式来探讨在公益报道中,如何认定关于未成年人报道的新闻侵权。
After the Wenchuan earthquake in 2008, public service reports mushroomed in our news reports. Public reporting not only reflects the prosperity of China’s public welfare undertakings, but also a way for the media to shoulder social responsibilities. However, in our public service reports, the protection of the privacy and name rights of minors is always under threat. Due to the special nature of public reporting, the third game, the public’s right to know and the protection of the rights and interests of minors also exist between the game. This article intends to explore from the Hande formula how to identify the news infringement reported by minors in public service reports.
