互联网时代的到来加速了人类社会的信息化进程,网络甚至成为文化信息传播的主要途径和手段,人们利用网络发表作品、传播作品以及使用作品的情况已相当普遍。与此同时我们发现,由于网络自身具备传播速度快捷、方法简便、成本较低等特点所导致的网络著作权侵权现象也呈逐年上升趋势。本文拟从网络环境中著作权问题涉及的基本理念出发,重点针对网络环境中著作权人的基本权利、权利限制及利益平衡理论进行讨论,提出解决问题的基本思路。
The advent of the Internet era has accelerated the process of informationization in human society. The Internet has even become the main means and means of disseminating cultural information. It is quite common that people use the Internet to publish, disseminate and use works. At the same time, we find that the network copyright infringement caused by the fast propagation speed, simple method and low cost has also been on the rise year by year. Based on the basic concepts involved in the copyright issue in the network environment, this article focuses on the discussion of the basic rights, rights restrictions and the balance of interests theory of the copyright owners in the network environment and puts forward the basic ideas for solving the problems.
