《北京市城市房地产转让管理办法》(以下称“管理办法”)由北京市人民政府于2003年09月02日颁布,随后北京市国土资源和房屋管理局根据管理办法的规定,制定了《<北京市城市房地产转让管理办法>实施意见》(以下称“实施意见”),并于2003年11月28日颁布。管理办法及实施意见已于2003年12月01日实施。为此,北京市国土房管局根据管理办法第五十六条的规定,对《商品房买卖合同》(以下称“旧版合同”)作了重新修订,新版《商品房买卖合同》已于2003年12月12日发布。现本所就旧版合同与新版合同之间所存在差异,以及新旧版合同中均存在的需开发企业在实际应用中加以注意的主要方面,简要对照和分析如下:
