案例李某等系北京某网络科技有限公司员工,月工资为5000元,其中基本工资1 000元,岗位工资4000元。该公司2000年7月制定的《工资管理制度》规定,每月从员工岗位工资中扣除一定比例作为期薪,年底根据公司的盈亏情况,决定当年员工能否享有期薪及期薪的数额。公司工资管理制度还规定,期薪即年终奖,是将员工工资的一部分变现为等值的工资股份效益,由奖金、股票组成。李某等每月被扣除岗位工资1000元作为期薪。2001年底,公司以效益不好,经营亏损为由不发放所扣除的期薪。李某等认为公司不支付所扣除的工资侵犯了自己的合法权益,双方发生争议,遂向北京市劳动争议仲裁委员会提出申诉,请求公司如数发放所扣工资。
