当前,我国诉讼法学界以证据制度为主题,开展了多方面、富有成果的研究。我国立法机关也将刑事证据立法提上了议事日程。不管是证据制度还是证据立法,都必须明确证明的标准问题。证明标准问题关系证据制度的理论基础,也是证据立法的一个重要方面和理论前提。为了帮助广大读者了解证明标准理论研究的最新进展,我们特组织了一组笔谈文章,以飨读者。
At present, China’s litigation jurisprudence has carried out a multifaceted and fruitful research on the evidence system. Our legislature also put criminal evidence legislation on the agenda. Both the evidentiary system and the evidence legislation must clearly identify the standard issues. It is also an important aspect and a theoretical premise to prove the theoretical basis of the evidence system of the standard problems.
