评米兰达审判“米兰达警告”(Miranda warning)是一种法律意义上的正式警告,依据米兰达案裁决,要求美国警察在讯问犯罪嫌疑人之前必须向受刑事羁押的犯罪嫌疑人提出这一正式警告,旨在确保被指控者知晓或者经提醒而意识到根据美国宪法而应享有的权利,以及他们在谈话期间的任何时刻都可以援引这些权利。促使启动米兰达防卫的情形条件是“羁押”和“讯问”。“羁押”意味着正式逮捕或者在一定程度上与之相关的对人身自由的剥夺,而“讯问”则意味着具有合理可能地引出归罪回应的明确提问或者行动。
Commentary Miranda warning is a formally legal warning and based on the Miranda decision, the U.S. police are required to submit to the suspect under criminal custody before interrogating the suspect This formal warning is designed to ensure that accused persons are aware of or are reminded of the rights they are entitled under the United States Constitution and that they may invoke these rights at any time during the conversation. The conditions that prompted Miranda's defense to start were “detention” and “interrogation.” “Detention” means official arrest or, to some extent, deprivation of liberty of person, and “interrogation” means having a clear question or action that leads to a reasonable response to a guilt response.
