传统谈到证人保护,更多的考虑是给证人提供一系列的保障机制,鼓励证人出庭作证。这样做的好处,一方面有利于发现案件的真实情况,另一方面保障了被告人质证权的实现。传统的证人保护的立法目的在于有效地追诉犯罪、保障被告人的对质诘问权,证人保护成为这两大旗帜之下的附带性反射利益。本文试图树立证人非诉讼客体(主体)的观念,弱化过去诉讼中证人义务本位的观念,转而更多关注他们的权利尊重和保障,真正地站在证人的角度思考,为其提供保护。
Traditionally, when it comes to the protection of witnesses, more consideration is to provide witness with a series of safeguard mechanisms to encourage witnesses to testify in court. The benefits of doing so, on the one hand, are conducive to discovering the real situation of the case and on the other hand, guaranteeing the realization of the defendant’s right of confrontation. The traditional legislative purpose of witness protection lies in effectively prosecuting crimes, guaranteeing the accused’s right of confidentiality, and witness protection becoming the incidental reflective benefits under these two banners. This paper attempts to establish the concept of non-litigant object (subject) and weaken the concept of the duty-based position of witnesses in past litigation, and instead pay more attention to their rights and protection, and really stand on the witness’s perspective to provide protection.
