被告人张如意,男,46岁,原系河南省驻马店市第一建筑公司第二施工队长。1994年3月21日河南省上蔡县公安局以强奸罪对被告人张如意立案侦查。4月21日移送检察院审查起诉。1994年5月21日上蔡县人民检察院向上蔡县人民法院提起公诉。起诉书认定被告人张如意犯罪事实如下:1994年3月21日凌晨二点左右,被告人张如意酒后窜至工地材料员、现役军人之妻刘某房中(此屋兼施工队办公室,张有此房钥匙)。进屋后欲行不轨,刘极力反抗,将张如意的胳膊,后背等部位抓伤,刘在头部被撞昏迷情况下遭张如意强奸。事后,刘趁张如意不备,抱起张的衣服跑出门外,
