本文通过对程序性制裁进行内在的逻辑区分,主要从为何对程序性违法施以制裁及为何对之施以程序上的制裁进行讨论。笔者通过“新程序性主义”的角度来考察这种区分的原因,试图找出对程序性制裁这一法律制度的理论支撑,最后运用前述区分提出对程序性制裁局限性的一些见解。
In this paper, procedural sanctions by the internal logical distinction, mainly from the why the procedural violations of sanctions and why the procedural sanctions are discussed. The author examines the reasons for this distinction through the perspective of “new proceduralism” and tries to find out the theoretical support for the legal system of procedural sanctions. Finally, we apply the above distinction to put forward some opinions on the limitations of procedural sanctions.
