随着社会的日益飞速发展,对行政机关的一切行政活动随之提出了更高要求,即一切行政活动都必须符合法律,也即依法行政。依法行政是建设社会主义法治国家在行政领域的体现。依法行政是依法治国的关键,是对依法治国的落实。行政机关不但在制定规范、实施立法活动等抽象行政行为时应做到依法行政,而且依法行政要求行政机关在执行法律、法规、规章的过程中也必须严格遵守。依法行政对于维护国家法制的统一和尊严、维护宪法的权威、对于监督行政机关依法行使职权、对于维护行政相对人的合法权益具有重要意义。
With the rapid development of society, all the administrative activities of the executive authorities subsequently put forward higher requirements that all administrative activities must comply with the law, that is, according to the law. Administration according to law is the embodiment of building a socialist country under the rule of law in the field of administration. Administration according to law is the key to governing the country according to law and the implementation of governing the country according to law. The executive authorities should not only conduct administration according to law when establishing normative and implementing abstract administrative acts such as legislative activities, but also require administrative organs to strictly comply with the laws, rules and regulations in the process of implementing them according to law. Administration according to law is of great significance in safeguarding the unity and dignity of the state legal system and safeguarding the authority of the constitution. It is of great significance to supervise the executive authorities in exercising their functions and powers in accordance with the law and for safeguarding the lawful rights and interests of the counterparts in the administration.
