警察权力是国家赋予警察为履行维护社会秩序职能而依法实行的强制力量。警察权力属于国家权力的范畴,是国家权力的重要组成部分。警察权力来源于法律的授权,警察权力法定是现代国家逐步走向法治、民主、文明的标志。警察权力是国家的强制之权,是国家强制力的具体体现,是国家管理权力中最严厉的权力。警察权力的核心是刑事侦查权和社会治安管理权。警察权力是现代国家管理社会的重要手段,是国家其他行政管理职能得以行使的保障。警察权力与人权并不冲突,警察机关依法、正确行使警察权力的最终目的就是尊重和保障人权。警察权力与警察权威相辅相成。
Police power is the mandatory force that the state gives to the police in accordance with the law to carry out the functions of maintaining social order. Police power belongs to the category of state power and is an important part of state power. The power of police comes from the authorization of law. The law of police power is the symbol of the modern state gradually moving towards rule of law, democracy and civilization. Police power is the right of the state to compulsion, a concrete manifestation of state coercion and the most severe power in the management power of the state. The core of police power is the right of criminal investigation and public order management. Police power is an important means of managing the society in modern countries and a guarantee for other state administrative functions to be exercised. There is no conflict between police power and human rights. The ultimate aim of police organs to properly exercise police power in accordance with the law is to respect and safeguard human rights. Police power and police authority complement each other.
