基于目前我国刑法学知识转型的背景和法学本科教育的目的,教学者应当在犯罪论体系上做出立场选择。缘于多种复杂因素,教学者对体系之选择并非易事。教学者对犯罪论体系做出了立场选择,但也不能过于夸大自己所选择的或所赞成的体系而有意贬低其他体系。无论选择何种犯罪论体系,教学者应当尽力做好的是讲清楚不同体系下可能存在的问题及可行的问题解决方案,而非单纯沉醉于不同体系的优劣之争。同时,教学者应当通过教学过程的共鸣,引导学习刑法学的年轻学子对“风险社会的刑法危险”保持高度警惕。
Based on the current background of knowledge transfer of criminal law in our country and the purpose of law undergraduate education, teachers should make their position choices on the crime theory system. Due to a variety of complicated factors, the choice of teaching system is not easy. The instructor makes a choice of position on the system of criminality, but not too much exaggeration of the systems he has chosen or agreed to deliberately belittle other systems. Regardless of the system of crime chosen, the instructor should try his best to clarify possible problems and solutions to possible problems in different systems, rather than just indulging in the contest of advantages and disadvantages of different systems. At the same time, the teaching staff should guide the young students who study criminal law through the resonance of the teaching process to keep a high degree of vigilance on the “criminal danger of risk society”.
