家政服务业作为第三产业已开始蓬勃发展,但家政行业法律规范欠缺,家政服务人员与雇主之间、与家政企业之间的关系在引起纠纷处理时,很难找到恰当的法律依据。该行业法律的缺失已严重影响到家政服务人员工作的积极性、家政服务机构发展可持续性及雇佣方对家政行业的信任感,所以现在该行业的立法问题已迫在眉睫。
The domestic service industry as the tertiary industry has started to flourish. However, the legal norms of the domestic service industry are lacking. It is very difficult to find the proper legal basis for the relationship between the domestic service workers and employers and the domestic enterprises in handling disputes. The absence of laws in the industry has seriously affected the enthusiasm of domestic service workers, the sustainability of the development of domestic service agencies and the trust of domestic employers in the domestic industry. Therefore, the issue of legislation in the industry is imminent.
