《物权法》已颁布多年,而物业纠纷仍时有发生。在这个背景下,扬州大学法学院的同学组成了实践团队,深入扬州各社区进行了20天的调查,对共有权运行状况进行了全方面的了解。改善物权法被架空的现状,需要改变思路,从实际出发,重新进行制度构架:明确业主委员会建立的时间点和规范,明确其牵头组织,建议由当地人大进行对应;对业主委员会成立后的运行进行指导,对业主委员会的合法性进行评估;在同时出现两个以上业主委员会进行了登记时,参照登记对抗主义和异议登记进行规范。
“Property Law” has been promulgated for many years, and property disputes still occur from time to time. In this context, Yangzhou University School of law students formed a practical team, in-depth community in Yangzhou conducted a 20-day investigation of the right to operate a full understanding of the situation.
