由国内十六位著名法理学家合作编写的普通高等教育“十五”国家级规划教材暨教育部面向21世纪课程教材《法理学》,在2003年修订后的第二版中增加了一章“法与生态文明”。法理学家在教材中明确指出,“生态文明需要法律确认和保护”。[1]本刊在此推出由徐祥民教授主持的同题笔谈,不仅从法理的层面阐述了法学理论在生态文明中的革命,而且结合生态文明背景下的环境法制建设、环境法学理论发展,做了言简意赅的表达,反映了学者们对“法与生态文明”的新认识。
The national Tenth Five-Year Planned Teaching Material for Higher Education and the Jurisprudence Course for the 21st Century, which was prepared by the 16 famous jurisprudents in China, added a chapter to the revised second edition in 2003 “Law and Ecological Civilization.” The jurists clearly pointed out in the teaching materials that “ecological civilization needs legal confirmation and protection.” [1] Our publication here is the same title written by Prof. Xu Xiangmin, not only explaining the revolution of legal theory in ecological civilization from the perspective of jurisprudence, but also combining with the development of environmental legal system and environmental law in the background of ecological civilization, The expression of conciseness reflects the new understanding of “law and ecological civilization” by scholars.
