侵权行为法的立法模式概括为一般化立法模式与类型化立法模式,在制定中国侵权行为法的时候,应当将这两种模式适当结合。即对一般侵权行为进行一般化规定,规定一般侵权行为的一般条款,将侵权行为法的一般条款的立法模式归纳为法国的大一般条款模式和德国的三个小一般条款模式,并建议采德国模式,此外,还应当对特殊侵权行为进行类型化规定。
The legislative mode of tort law can be summarized as generalized legislative mode and typed legislative mode. When formulating China’s tort law, the two modes should be properly combined.
