今年2月1日是《企业国有产权转让管理暂行办法》(以下简称《暂行办法》)实施一周年,一年的实践告诉我们,只有全面掌握相关法规,才能准确执行《暂行办法》。一、规范转让程序全面理解《暂行办法》和相关法规,我们认为国有产权转让要规范进行12步操作程序:(一)制定产权转让方案;(二)可行性研究;(三)内部审议决策;(四)产权转让行为审批;(五)清产核资、财务审计、资产评估;(六)选择产权交易机构;(七)披露产权转让信息;(八)组织实施产权交易;(九)转让方案是否有重大调整;
February 1 this year is the one-year anniversary of the implementation of the Interim Measures for the Administration of the Transfer of State-owned Property Rights (hereinafter referred to as the “Interim Measures”). One year’s practice tells us that the “Interim Measures” can be implemented accurately only when the relevant laws and regulations are fully in place. I. Standardizing the Transfer Procedure To fully understand the “Interim Measures” and the relevant laws and regulations, we think that the transfer of state-owned property rights should regulate the 12-step operating procedures: (1) formulating the transfer of property rights; (2) feasibility study; (3) internal review and decision-making; (4) The examination and approval of the transfer of property rights; (5) The examination and approval of the capital verification and financial audit of assets and assets; (6) The selection of property rights trading institutions; (7) The disclosure of property rights transfer information; Is there any major adjustment?
