在证据意识日益浓烈的现代社会,行政程序中证明责任的合理分配对于实现行政结果的公平、行政程序的高效具有积极意义。行政事务的复杂性和专业性决定了行政程序与行政诉讼中的证明责任在说服对象及内涵上的本质区别。在行政程序中确立由行政主体承担主要证明责任、行政相对人承担特殊证明责任的分配规则更为适合我国的法治现实。
In the modern society where the growing evidence consciousness is strong, the reasonable distribution of the burden of responsibility in the administrative procedure is of positive significance to the fairness of the administrative result and the high efficiency of administrative procedure. The complexity and specialty of administrative affairs determine the essential differences in the object and connotation of the burden of proof in administrative procedures and administrative proceedings. In administrative procedures, it is more suitable for our country’s reality of rule of law to establish the distribution rules that bear the main burden of proof on the part of the administrative body and on which the administrative counterparts bear the special burden of proof.
