别居制度(Separation System)起源于基督教会法,盛行于中世纪的西欧。目前仍在国外许多国家及我国港澳地区普遍适用,并被赋予了新的内涵和功能,成为一项有利于缓和夫妻矛盾、修复婚姻关系、保障夫妻权利、保护第三人利益的先进制度。我国内地迄今为止都没有建立别居制度,新修订的婚姻法只是把夫妻分居满2年的事实明确规定为判决离婚的法定依据之一,除此之外没有相关配套规定,从而导致许多当事人对分居处于懵懂状态,法院也无明确的法律可依,最终于当事人行为的规范及其合法权益的保护和司法机关的操作均不利。本文在对别居制度的历史及其现代内涵进行考察引介的基础上,论证了我国建立别居制度的必要性和可行性,希望能对我国婚姻立法的进一步完善和保障我国婚姻、家庭、社会的稳定起到抛砖引玉的作用。
Separation System (Separation System) originated in the Christian Church Act, prevalent in Western Europe in the Middle Ages. It is still widely applied in many foreign countries and in Hong Kong and Maucao of our country and has been given new connotations and functions. The newly revised Marriage Law only stipulates the fact that the spouses are separated for two years as one of the statutory bases for the verdict of divorce. In addition, there are no relevant supporting regulations, resulting in many parties’ In the ignorant state, the court has no clear law to follow, and finally the norms of the parties and the protection of their legal rights and interests of the judiciary are adverse. Based on the introduction of the history and modern connotation of alien housing system, this article demonstrates the necessity and feasibility of establishing alien housing system in our country, hoping to further improve the legislation of our country’s marriage and protect our marriage, family and society The stability played a valuable role.
