由于不动产交易中的违约行为而不能实现合同目的现象屡屡发生,为保障不动产交易安全,我国刚刚颁布的《中华人民共和国物权法》新设立了预告登记制度是值得肯定的,但是在法条设计和法律实践中,都存在着大量的不完善与不和谐。通过对该制度发源地德国在这一问题上的立法设计分析,欲找到差距与缺失,从而为更好地将预告登记制度运用于保护交易各方,尤其是买受方的合法权益,促进公平交易,维护交易秩序,能够彰显中国法律保护私权力度日益增强的时代性。
