经济法作为一种调整一定社会经济关系的法律,已经显示出强大的生命力。但是,对其基础理论的研究,仍然是个薄弱环节。我们认为,对经济法基础理论的研究,不能割断历史发展,更不能脱离经济活动,只有这样,才能找到经济法的产生和发展的客观基础,找到经济法的本质特征。本文试图从经济活动的深层领域,并结合经济法产生的历史来考察经济法产生的客观经济基础,以期对经济法基础理论研究的深入发展。
Economic law, as a law regulating certain social and economic relations, has shown great vitality. However, the study of its basic theory is still a weak link. In our opinion, the study of the basic theory of economic law can not separate the historical development from the economic activities. Only in this way can we find the objective basis for the emergence and development of economic law and find the essential features of economic law. This article attempts to examine the objective economic basis of economic law from the deep field of economic activity and the history of economic law, with a view to the further development of the basic theory of economic law.
