长久以来,盘古开天地,血为淮滨,民间传说广为流传。近日,因盘古神话传说而引发了一场侵权官司,在学术界引起了极大关注。2008年3月17日,河南省南阳市中级人民法院对《盘古之神》作者马卉欣状告《盘古神话》作者张正等侵犯著作权一案作出一审判决,判令四被告停止侵权,公开道歉,并赔偿原告经济损失5万元。据了解,被告已经向上级法院提起了上诉。在国务院尚未出台民间文学艺术作品著作权保护办法的情况下,类似案件到底应该如何审理呢?
