透过大型数据中心与虚拟化技术等相关技术使提供像水电一般服务的云计算(Cloud Computing)目标要求得以实现。虽然云计算使得计算资源的整体使用分配更具有效率,同时也大幅降低了中小型规模业者自行投资组建网络设备所需面临的商业风险。但是从法律层面观察,云计算所衍生的服务使用合同问题以及对于服务等级协议(Service Level Agreement)的定位将变得更为显著。本文试图透过云计算的问责(Accountability)概念来分析检讨合同以及服务等级协议在实务中产生的争议与解决之道。
Relevant technologies such as large data centers and virtualization technologies have enabled the achievement of Cloud Computing goals like utilities. Although cloud computing makes the overall allocation of computing resources more efficient, it also drastically reduces the business risk faced by small and midsized businesses by investing in network equipment. However, from a legal perspective, cloud-derived service usage contract issues and positioning for service level agreements will become even more pronounced. This article tries to analyze the concept of review and review of contracts and the dispute arising from the service level agreement in practice as well as the solution through the concept of accountability in cloud computing.
