随着“走出去战略”的实施,中国已经兼具“资本输入”和“资本输出”的双重角色。2015年的相关统计数据表明,中国已经成了资本净输出国。这种资本输入与输出的结构要求中国必须重视国际投资法的研究与教学。结合笔者在国际投资法教学方面的实践以及学生的反馈,认为需要从以下方面强化国际投资法的教学:强调国际投资法历史方面的研究、构建一个综合性的国际投资法学科框架、结果具体案例研究国际投资法的核心条款以及注重国际投资法与其他国际法分支间的融合与互动。
With the implementation of “Going Global Strategy”, China has dual roles of “capital input” and “capital output.” Relevant statistics in 2015 show that China has become a net capital exporter. This structure of capital input and output requires that China must attach importance to the research and teaching of international investment law. Combining with the author’s practice in the teaching of international investment law and the feedback of students, he believes that it is necessary to strengthen the teaching of international investment law from the following aspects: emphasizing the history of international investment law research and building a comprehensive framework of international investment law, with specific cases Study the core provisions of international investment law and focus on the integration and interaction between international investment law and other branches of international law.
