《城市商品房预售管理办法》、《物权法》等相关法律法规的实施,对规范商品房预售活动起了一定的积极作用。但因为其本身固有的属性决定其对预购人的权利保护存在局限性。本文首先论述了我国商品房预售的相关立法及其缺陷,然后从完善预售信息披露制度、商品房预售准入制度等方面论述了相关调整措施。
The Measures for the Administration of Sale of Urban Commercial Housing, the Real Right Law and other relevant laws and regulations have played a positive role in regulating the pre-sale activities of commercial buildings. However, because of its inherent nature of the decision of its pre-purchaser rights protection there are limitations. This article first discusses the relevant legislation and its defects in the pre-sale of commercial housing in our country, and then elaborates the relevant adjustment measures in terms of perfecting the pre-sale information disclosure system and the pre-sale system of commercial housing.
