次级证明是英国学者尼尔·麦考密克的法律推理理论中的核心概念,是指法律规则不确定的情况下,通过一般性规定、类比、或法律原则等方式推理明确或确认法律规则的过程,包括后果主义论辩、协调性论辩和一致性论辩。我国司法实践中,存在着法官寻找和确立法律规则的事实。在L浏览器不正当竞争案的分析过程中,说明中国司法实践中存在的次级证明是什么样的,进而结合麦考密克的法律推理理论说明法官进行次级证明应遵循怎样的规范。
The secondary proof is the core concept of the British scholar Neil McCormick’s theory of legal reasoning. It means that under the circumstance that the legal rules are not certain, the rules of law, the analogy, or the principle of law are used to reason about the definite or confirmed legal rules The process, including the consequences of the argument, coordination and consistency of argument. In our judicial practice, there is the fact that judges look for and establish legal rules.
