在我国建立刑事被害人国家补偿制度既具有必要性又具有可行性,被期待说是建立刑事被害人国家补偿制度的理论基础。构建刑事被害人国家补偿制度应当在公平正义、损害和补偿均衡、赔偿为主补偿为辅的原则指导下进行,在借鉴各国立法的基础上,构建既符合我国国情又具备先进理论框架支撑的刑事被害人国家补偿制度。
It is both necessary and feasible to establish a national compensation system for criminal victims in our country and it is expected that this will be the theoretical basis for establishing a state compensation system for criminal victims. The system of state compensation for the construction of criminal victims should be guided by the principle of fairness, justice, damage and balance of compensation, with the compensation as the main supplement, supplemented by compensation.
