近些年来,随着我国依法治国战略的不断实施与深化,对我国法律体系的建设与完善也不断提出更高的要求。民法是我国法律体系中基本的组成部分,民法基本原则是当前我国法学界和知识产权保护制度研究工作中十分关注的内容。《民法通则》在我国发挥着民法典的功能和作用,民法基本法则也可以成为私法基本原则,也是我国私法最高法则。本文就主要针对民法基本原则在知识产权法中的相关应用进行简单的分析。
In recent years, with the continuous implementation and deepening of our country’s strategy of administering the country by law, we have also constantly put forward higher requirements on the construction and improvement of our legal system. Civil law is a basic part of our legal system. The basic principle of civil law is a very concerned part in the current research on legal system and intellectual property protection in our country. The “General Principles of Civil Law” plays the function and role of civil code in our country. The basic law of civil law can also become the basic principle of private law and also the supreme law of private law in our country. This article mainly analyzes the basic application of the basic principles of civil law in intellectual property law.
