交通肇事罪应该如何认定,司法实践中应当如何处理,有着许多的争议。尤其是《刑法》133条将“逃逸致人死亡”规定为交通肇事罪的加重情节,把它和不作为犯罪区分开来。本文从“交通肇事逃逸行为”出发,以不作为犯罪理论分析“逃逸致死”的多种情况,把不作为故意杀人罪作为基础,探寻“因逃逸致人死亡”的肇事行为人和被害人间的特殊关系。同时,利用分析“因逃逸致人死亡”法律条文中的争议问题,从主体,心理态度,加重情节性质等方面,阐述了立法机关以“逃逸致人死亡”的情形作为“交通肇事罪”加重情节来处理的科学性。
