“货物控制权”作为出现已久的事物,既有的货物运输公约和民间规则对之均有规定,但是在细节规定上有所不同。是指托运人在运输合同下对货物的处分权。《鹿特丹规则》首次以专章形式对货物控制权作了较为完备的体系化构建,然而其制度内核并无多大新意。货物控制权的制度价值重在确保不可转让运输单证使用下货方阵营多个主体针对货物的各项权益安全、有序的实现。维护国际商贸,尤其是国际海运各环节的安全、高效和有序。《中华人民共和国海商法》缺乏货物控制权规定。我国《合同法》第308条的规定过于简陋。
