邓小平党法关系思想是马克思主义法学理论中国化的重要成果,其核心观点主要有:坚持党的领导是依法治国的根本性前提;共产党人既是依法治国的核心主体,又是模范遵法守法的表率;坚持党的领导和依法治国是辩证统一的有机整体。邓小平关于正确处理党与法关系的思想之当代价值蕴涵于构建中国特色社会主义法律体系和建设中国特色社会主义法治国家的伟大实践之中。
Deng Xiaoping’s thinking on the relationship between the party and the law is an important achievement of the sinicization of Marxist jurisprudence. The core views are as follows: Maintaining the party’s leadership is the fundamental premise for governing the country according to law. Communists are both the core subject of governing the country according to law and the model ; Insisting that the party’s leadership and administering the country according to law are the organic whole of dialectical unification. The contemporary value of Deng Xiaoping’s thinking on correctly handling the relationship between the party and the law lies in the great practice of building a socialist legal system with Chinese characteristics and building a socialist country with Chinese characteristics.
