自1999年行政復議法頒佈實施以來,全國人大常委會於2013年首次檢查該法的實施情況。統計結果顯示,中國每年受理的行政復議案件數量與行政訴訟的一審案件數量基本持平,部分地方的復議案件還多於一審行政訴訟案件,而多數的行政復議案件涉及土地、房屋拆遷、勞動和社會保障、衛生、城市規劃等與群眾利益密切相關的領域。作為化解行政爭議的第一道防線,國務院在推動行政復議法修改的同時,在實踐中也積極探索建立專業、便民、高效、權威的行政復議體制,整合多頭行政復議辦案機關,部署行政復議委員會試點是其中一項有益探索。本期特選取國務院法制辦公室行政復議司副司長方軍的文章,全面解讀行政復議委員會試點工作開展五年以來的實效及未來走向。
Since the enactment of the Administrative Reconsideration Law in 1999, the NPC Standing Committee first examined the implementation of the law in 2013. The statistical results show that the number of administrative reconsideration cases handled each year in China is basically the same as the number of first instance cases in administrative litigation. In some places, there are still more second-case administrative reconsideration cases than administrative litigation cases, while most of the administrative reconsideration cases involve land, house demolition, labor and society Protection, health, urban planning and other areas closely related to the interests of the masses. As the first line of defense to resolve administrative disputes, the State Council, while promoting the revision of the Administrative Review Law, has also actively explored in practice the establishment of a professional, convenient, efficient and authoritative system of administrative reconsideration, integrating multiple administrative reconsideration and handling organs and deploying the Administrative Reconsideration Committee Pilot is one of the useful exploration. In this issue, we specially select the article by Fang Jun, the deputy director of the administrative reconsideration department of the Legislative Affairs Office of the State Council, to comprehensively interpret the actual results and future trends of the pilot work of the Administrative Review Committee since the five-year plan was carried out.
