新闻报道是事关公民名誉的行为。新闻媒体在报道新闻时,虽然只是客观反映新闻事实本身,但对新闻的选择却总带有或贬或褒的主观态度。选择贬,则会令当事人名誉受损;选择褒,则令当事人名誉获益。如果贬褒过程中新闻从业者主观无过错,则不存在新闻侵权问题,而一旦贬褒过程存在过错,则会导致对当事人名誉权的侵害。根据笔者近年来对新闻侵权案类型的分析,新闻侵害名誉权案占所有新闻侵权类型的60％-70％,是名符其实的第一侵权类型。
