驰名商标的反淡化保护问题在世界各国一直是个很有争议的话题,理论研究者和司法实践者对此各持己见。不仅对该制度的具体内容有所争议,就连对该制度是否有存在的必要也一直没有达成共识。我国在这方面的理论研究更是薄弱。笔者在这篇文章中,借鉴国外对驰名商标反淡化保护的成功经验,提出了完善我国驰名商标反淡化保护的具体建议,希望引起有关方面的重视,推动我国驰名商标反淡化保护问题的研究,进一步完善我国的驰名商标反淡化保护制度。
Anti-dilution protection of well-known trademarks has always been a topic of controversy in various countries of the world. Both theoretical researchers and judicial practitioners hold their own views. Not only the specific content of the system is controversial, there has been no consensus on the necessity of existence of the system. Our country’s theoretical research in this area is even weaker. In this article, the author draws on the successful experiences of anti-dilution protection of well-known trademarks in foreign countries and puts forward concrete suggestions on how to improve anti-dilution protection of well-known trademarks in our country. It hopes to attract the attention of relevant parties and promote the research on anti-dilution protection of well-known trademarks in our country. Further improve China’s well-known trademark anti-dilution protection system.
