检察制度改革必须遵循三个基本规律:即检察权运行司法化、法律监督诉讼化、制度设计科学化。检察权运行司法化要求建立以检察官为顶点的审前司法审查制度,对公诉制度进行司法化改造;法律监督诉讼化要求在建立行政、民事公诉制度的同时,完善刑事诉讼制度,建立诉讼行为无效制度和公诉中止制度;制度设计科学化则要求检察制度的设计必须以维护国家法制统一为主要目的,以权力制衡为原则,以公平正义、效益为价值取向。
The procuratorial system reform must follow three basic rules: that is, prosecutorial power runs judicialization, legal supervision and litigation, and system design is scientific.
