在推进依法治理工作中,广大农村普遍制定了村规民约,内容相当广泛,上至法律行为,下至道德规范,大都作了详细规定。应该说这些村规民约在规范人们行为,促进农村基层依法治理、村民自治工作中起到了积极作用。但是不容忽视的是这些村规民约中有一些规定与法律、法规不相符,甚至是违法的规定。突出的表现就是将有些应该用道德规范的行为作了惩罚性的规定,同时村规民约中惩罚性条款有一些与现行法律相违背。
In promoting the administration according to law, the majority of rural areas generally formulated the village rules and regulations, covering a wide range of contents, ranging from legal acts to moral norms, and most of them made detailed provisions. It should be said that these village rules and regulations play an active role in standardizing people’s behaviors, promoting governance by law in rural areas and villagers’ autonomy. However, it can not be ignored that there are some provisions in these Mukdenvillaim conventions that are inconsistent with laws and regulations and even illegal. Outstanding performance is that some should be ethical behavior punishable provisions, while the punitive provisions of the village rules and regulations some of the current law is contrary to.
