物业管理自治是我国物业管理未来的发展方向,在我国由于物业管理体系的不规范和相关法律制度的不健全,政府和物业公司没有及时履行其职责,以及广大业主参与决策意识和维权途径的缺失,导致业主自治制度在推行过程十分艰难。文章针对上述业主自治制度中的问题,提出应对的决策包括:健全法律制度,扩充业主维权的渠道,重新构建业主自治组织,明确政府和物业公司在自治过程中的责任与义务,加强对业主参与自主决策和维护合法权益的意识。
Property management autonomy is the future direction of property management in our country. In our country, due to the non-standard property management system and the imperfect legal system, the government and property companies do not fulfill their duties in time and the lack of awareness of the majority of landlords in decision-making and rights protection , Resulting in the implementation of the owners autonomy system is very difficult. In order to solve the problems in the owners’ autonomy system, this paper puts forward some countermeasures such as improving the legal system, expanding the channel of safeguarding the rights of owners, rebuilding the autonomy organization of the owners, clarifying the responsibilities and obligations of the government and property companies in the autonomy process, Self-decision-making and safeguarding the awareness of legitimate rights and interests.
