我国的《刑事诉讼法》在吸取实施以来的经验教训基础上,借鉴外国立法的文明成果。在全国人大修改的时候,尤其要吸收美国在保障律师会见权方面的规定,从立法上推进对人权的保障,体现社会主义制度的优越性,体现法律的科学发展性。作者从律师会见难入手,分析了侦查中的危害并提出了在修改《刑事诉讼法》时解决的对策。
China’s “Criminal Procedure Law” draws on the lessons learned since its implementation and draws on the civilized achievements of foreign legislation. When the NPC changes, the United States should especially absorb the provisions of the United States in safeguarding the rights of lawyers, promote the protection of human rights from the perspective of legislation, embody the superiority of the socialist system and embody the scientific development of the law. The author starts with the difficulty of lawyers’ meeting, analyzes the harm in the investigation and puts forward the countermeasures to solve in the revision of “Criminal Procedure Law”.
