体育权制度是随社会文明的进步和对人的尊严及自由的日益重视 ,权利的种类和内容不断得以扩充和完善而进入人类文明体系的。通常以为一种权利从提出到切实保护 ,为人们所充分拥有 ,需要经过三个阶段 ,即应有权利阶段、法定权利阶段、实有权利阶段。现在 ,当体育权制度在众多国家中已经进入实有权利阶段时 ,我国学术界对体育权的理论研究却几乎是一片空白 ,当然也就谈不上法定或实有的权利。试从学校教育体系的角度来对体育权制度在我国的拥有可能与拥有方式作一点粗浅的探讨 ,同时也为为什么网络教育等新型的教育模式不可能全面取代传统的学校教育模式提供一定的依据
With the progress of social civilization and the increasing emphasis on human dignity and freedom, the system of the right to sports has entered into the system of human civilization with the continuous expansion and improvement of the types and contents of rights. It is generally assumed that a right from the proposed to the effective protection of people fully owned, need to go through three stages, that is, the right stage, legal rights stage, real rights stage. At present, when the system of the right to physical education has entered the stage of real right in many countries, the theoretical study of the right to physical education in our academic circles is almost a blank. Of course, there are no legal or practical rights. From the perspective of school education system, the author thinks that ownership of sports rights system in our country may have a little superficial discussion on the ways of ownership, and at the same time, it also provides a basis for why it is impossible to completely replace the traditional school education model by new educational modes such as online education
