自从人类历史上产生了办理刑事案件的刑事诉讼,同时也就出现了刑事疑难案件(以下简称“疑案”)。在中国古代法律文献中,疑案又称作疑狱或者疑罪,一般解释为“疑,谓虚实之证等,是非之理均;或事涉疑似,旁无证见;或旁有闻证,是非疑似之类”。在外国法律中,一般则称作不能证明犯罪的案件或者证据不足的案件。我国现行刑事诉讼法第107条、人民法院组织法第11条也都出现了“疑难案件”这一概念。但是,什么样的案件才能称为疑案?对疑案应当如何处理,法律均未作具体规定。这就给执法工作带来了困惑,以致造成司法机关对疑案不知怎么处理或者错误地作了处理。本文拟以疑案的概念入手,分析什么叫疑案以及疑案的处理原则等问题。
