内参是我国各级党政机关及组织所创办的内部定期秘密刊物,因其不面向社会大众广为发行,所以有的同志认为在内参上所刊文章不会发生侵权问题。对此,笔者不予苟同。笔者认为内参文章同样可以侵犯公民或法人的名誉权、荣誉权、肖像权、著作权、隐私权等民事权利,如情节恶劣还可能构成侮辱、诽谤或泄露法人的商业秘密等刑事犯罪。下面就此问题发表几点浅见以供各界同仁参考。一、内参虽是一种特殊的内

Because it is not widely distributed to the general public, some comrades think that there will be no infringement on articles published in the Internal Affairs Administration. In this regard, I do not agree. The author believes that internal reference articles can also infringe the civil rights of civil or legal persons such as reputation rights, honor rights, portrait rights, copyrights and privacy rights, and may also constitute criminal offenses such as humiliation, slander or disclosure of legal secrets of legal persons if the circumstances are adverse.
